Where applicable, mobile/SMS features will have separate terms. Your use signifies consent to receive recurring messages. Message/data rates from carriers apply. Opt-out is available via standardized keyword commands like STOP. Refer to your specific product documentation for details.
Our Privacy Policy is incorporated by reference. We collect and use data as described therein, and your use constitutes acceptance.
- You are responsible for account credentials and activity under your account.
- Notify us immediately if credentials are compromised.
- We cannot be held liable for unauthorized access due to compromised credentials.
All content, including text, graphics, software, and trademarks, is owned by CompuMail or its licensors. You may only use it for authorized purposes. Unauthorized reproduction or distribution is prohibited.
- You grant CompuMail a perpetual, royalty-free license to use, modify, or sublicense any data, feedback, or materials you submit.
- You must have lawful rights to any content you upload and must comply with these Terms.
You may not use the Services to:
- Violate applicable laws or third-party rights
- Upload malware or malicious content
- Interfere with platform operations or other users’ access
- Spam or distribute unsolicited content
Our Services may contain links to third-party sites. We don’t control or endorse their content, and your access is at your own risk.
Our Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, accuracy, and uninterrupted access.
- Monetary Cap: Our liability for claims is capped at $100 per year
- Excluded Damages: We are not liable for any indirect, incidental, special, or consequential damages—even if foreseeable
You agree to defend and indemnify CompuMail and its affiliates against claims arising from your use of the Services, breach of these Terms, or violation of third-party rights.
- These Terms remain effective until terminated.
- CompuMail may suspend or terminate services or accounts at any time, with or without cause.
- Upon termination, you must cease using the Services and destroy any materials obtained from them.
- These Terms are governed by the laws of the State of California, United States, excluding its conflict-of-law rules.
- Any disputes will be resolved exclusively in the state or federal courts located in Contra Costa County, California, and you consent to their jurisdiction.
- Assignment: CompuMail may assign these Terms. You may not without written consent.
- Severability: If any provision is invalid, the remainder remains enforceable.
- Entire Agreement: This document, with the Privacy Policy and applicable addenda, contains the full agreement.
